SMW applies to all employees including employees with disabilities. Therefore, employees with disabilities are also entitled to receive wages not lower than the SMW. A special arrangement is provided under the Minimum Wage Ordinance so that employees with disabilities whose productivity may be impaired by their disabilities are given the right to choose to undergo a productivity assessment to determine whether they should be paid not lower than the SMW level or at a rate based on their assessed productivity. The right to invoke assessment is solely vested in employees with disabilities.
