【緊急情況規例條例】政府訂立《緊急情況（豁免法定規定）（2019冠狀病毒病）規例》 (政務司/成文法/批予豁免/Government enacts Emergency (Exemption from Statutory Requirements) (COVID-19) Regulation) ...... !

​政府今日（二月二十四日）公布，已將根據《緊急情況規例條例》（第241章）訂立的《緊急情況（豁免法定規定）（2019冠狀病毒病）規例》（《規例》）刊憲，為政府推行中央支援的防疫抗疫措施，包括籌建醫院及隔離設施等，提供法律基礎。有關規例今日生效。

香港目前的疫情形勢十分危急，疫情持續急速惡化，並可預見2019冠狀病毒病的新增確診個案數目將繼續以幾何級數上升，已超出特區政府的疫情防控能力範圍。香港的醫療系統、人力資源、抗疫設備及物資等，很快將不足以應付每日數目龐大的新增確診個案，屬於《緊急情況規例條例》下緊急及危害公眾安全的情況。
 
因應現時的公共衞生緊急情況，行政長官會同行政會議於昨日（二月二十三日）通過訂立《規例》，以容許政府豁免某些人士或項目的相關許可、註冊及申請等法定要求，以便特區政府能夠在有需要時更靈活迅速地善用內地的支援及資源，全速開展關鍵的防疫抗疫項目，以期在短時間內提升香港的疫情防控能力以控制第五波疫情。
 
《規例》賦權政務司司長可為預防、抵禦、阻延或以其他方式控制指明疾病的個案或傳播，或治療感染指明疾病的病人，在顧及各種在《規例》中訂明的因素後，以書面方式批予豁免，容許人士或項目無須符合成文法則的若干規定（包括牌照、權限、批准、豁免、許可證、註冊、標準或規格的規定）。
 
《規例》將為中央政府為香港更有效迅速地提供必要緊急支援的提供法律框架。特區政府會負起抗疫主體責任，用好中央政府的支持抗疫。在中央政府的大力支持下，只要市民大眾齊心，香港定必能戰勝疫情。

​​The Government announced today (February 24) the gazettal of the Emergency (Exemption from Statutory Requirements) (COVID-19) Regulation (the Regulation) made pursuant to the Emergency Regulations Ordinance (Chapter 241), with a view to providing the legal basis for the Government to implement the anti-epidemic measures supported by the Central People's Government (CPG), including the construction of hospitals and isolation facilities, etc. The Regulation has come into operation today.

     Hong Kong is now facing a very dire epidemic situation which continues to deteriorate rapidly. It is foreseeable that the number of newly confirmed cases of COVID-19 will continue to escalate exponentially and go beyond the epidemic control capacity of the Government of the Hong Kong Special Administrative Region (HKSAR Government). Hong Kong's healthcare system, manpower, anti-epidemic facilities and resources, etc. will soon be insufficient to handle the huge number of newly confirmed cases detected every day. Such situation has constituted an occasion of emergency and public danger as defined under the Emergency Regulations Ordinance. 

     In response to the current public health emergency situation, the Chief Executive in Council approved yesterday (February 23) that the Regulation is to be made with a view to allowing the Government to exempt certain persons or projects from all relevant statutory requirements in respect of licensing, registration and application, etc., such that the HKSAR Government may draw on Mainland's support and resources in a flexible and prompt manner to undertake key anti-epidemic projects at full speed when necessary, so as to increase Hong Kong's epidemic control capacity for containing the fifth wave within a short period of time.

     The Regulation empowers the Chief Secretary for Administration to, for preventing, protecting against, delaying or otherwise controlling the incidence or transmission of the specified disease or treating patients with the specified disease, having regard to the factors set out in the Regulation, grant an exemption in writing to persons or projects such that they do not have to comply with certain requirements under enactments (including a requirement for licence, authority, approval, exemption, permit, registration, standard or specification).

     The Regulation will provide a legal framework for the CPG to render the necessary emergent support to Hong Kong in a more effective and expeditious manner. The HKSAR Government will leverage support of the CPG and assume the main responsibility to curb the epidemic. With the staunch support by the CPG, Hong Kong will surely overcome the epidemic as long as the public in general acts in concert.
