以 下 為 今 日 （ 一 月 六 日 ） 在 立 法 會 會 議 上 ， 潘 佩 璆 議 員 的 提 問 及 公 務 員 事 務 局 局 長 俞 宗 怡 的 書 面 答 覆 ： 問 題 ： 較 早 前 ， 一 名 在 香 港 電 台 服 務 長 達 21 年 的 非 公 務 員 合 約 僱 員 於 工 作 期 間 腦 溢 血 死 亡 ， 但 政 府 卻 以 該 名 員 工 並 非 公 務 員 為 由 ， 堅 拒 向 其 遺 屬 發 放 恩 恤 金 ， 最 後 僅 發 放 長 期 服 務 金 及 強 積 金 。 本 人 獲 悉 ， 該 事 件 引 起 市 民 對 非 公 務 員 合 約 僱 員 的 附 帶 福 利 的 關 注 。 就 此 ， 政 府 可 否 告 知 本 會 ： （ 一 ） 按 部 門 及 職 系 劃 分 ， 政 府 現 時 聘 用 了 多 少 名 非 公 務 員 合 約 僱 員 ； （ 二 ） 按 持 續 服 務 的 年 期 （ 即 少 於 5 年 ， 之 後 每 5 年 為 一 組 至 20 年 或 以 上 ） 劃 分 ， 現 時 政 府 分 別 以 非 公 務 員 合 約 及 其 他 合 約 形 式 連 續 聘 用 的 員 工 數 目 ； （ 三 ） 過 去 5 年 ， 分 別 涉 及 非 公 務 員 合 約 僱 員 的 已 向 勞 工 處 處 長 呈 報 的 工 傷 個 案 ， 以 及 該 等 僱 員 在 工 作 期 間 死 亡 的 個 案 數 目 ； 及 （ 四 ） 除 了 向 在 工 作 期 間 死 亡 的 非 公 務 員 合 約 僱 員 的 遺 屬 發 放 長 期 服 務 金 及 強 積 金 外 ， 政 府 現 時 有 沒 有 向 該 等 遺 屬 或 因 工 受 傷 的 非 公 務 員 合 約 僱 員 提 供 任 何 實 質 支 援 ； 若 有 ， 該 等 支 援 與 向 公 務 員 及 其 遺 屬 提 供 的 支 援 如 何 比 較 ？ 答 覆 ： 主 席 ： 政 府 在 一 九 九 九 年 推 出 非 公 務 員 合 約 僱 員 計 劃 ， 目 的 是 為 常 任 秘 書 長 及 部 門 首 長 （ 以 下 簡 稱 「 部 門 首 長 」 ） 提 供 靈 活 的 方 式 僱 用 人 手 ， 以 便 更 迅 速 回 應 各 局 ／ 部 門 不 斷 轉 變 的 運 作 和 服 務 需 求 。 這 些 需 求 可 能 是 有 時 限 、 屬 季 節 性 或 受 市 場 波 動 影 響 ， 或 只 須 僱 用 工 作 少 於 規 定 工 作 時 數 的 人 手 ， 或 須 從 市 場 招 攬 在 特 定 範 疇 具 備 最 新 專 業 知 識 的 人 才 ； 又 或 應 付 服 務 方 式 正 待 檢 討 或 有 可 能 改 變 的 情 況 。 非 公 務 員 合 約 僱 員 計 劃 是 以 定 期 合 約 形 式 聘 用 ， 而 薪 酬 條 件 乃 是 「 全 包 式 」 ， 並 無 其 他 附 帶 福 利 。 部 門 首 長 可 按 工 作 的 性 質 、 就 業 市 場 的 情 況 ， 以 及 管 理 和 運 作 方 面 的 考 慮 ， 自 行 釐 定 非 公 務 員 合 約 僱 員 的 聘 用 條 件 ； 而 整 體 上 ， 非 公 務 員 合 約 僱 員 的 服 務 條 款 和 條 件 不 得 遜 於 《 僱 傭 條 例 》 （ 第 57 章 ） 的 規 定 ， 亦 不 得 比 適 用 於 職 級 或 職 責 相 若 的 公 務 員 （ 如 有 的 話 ） 的 聘 用 條 款 和 條 件 為 佳 。 此 外 ， 《 僱 員 補 償 條 例 》 （ 第 282 章 ） 的 適 用 範 圍 涵 蓋 政 府 僱 員 ， 包 括 非 公 務 員 合 約 僱 員 ； 因 此 ， 他 們 已 受 到 有 關 條 例 規 定 的 保 障 ， 包 括 在 受 僱 工 作 期 間 享 有 因 工 受 傷 的 有 薪 病 假 ， 以 及 因 工 遭 遇 意 外 以 致 死 亡 的 補 償 。 鑑 於 非 公 務 員 合 約 僱 員 計 劃 的 性 質 ， 公 務 員 事 務 局 只 會 每 年 兩 次 向 各 局 ／ 部 門 蒐 集 概 括 性 資 料 （ 例 如 所 聘 用 的 非 公 務 員 合 約 僱 員 數 目 、 月 薪 薪 幅 和 合 約 期 限 ） 。 簡 單 解 釋 非 公 務 員 合 約 僱 員 計 劃 後 ， 我 就 有 關 質 詢 答 覆 如 下 ： （ 一 ） 基 於 聘 用 非 公 務 員 合 約 僱 員 的 適 用 範 圍 ， 各 局 ／ 部 門 聘 用 非 公 務 員 合 約 僱 員 的 數 目 ， 會 按 服 務 及 運 作 需 求 的 轉 變 時 有 變 動 。 截 至 二 ○ ○ 九 年 六 月 三 十 日 ， 各 局 ／ 部 門 共 聘 用 16,186 名 全 職 （ 註 1） 非 公 務 員 合 約 僱 員 。 按 局 ／ 部 門 所 聘 用 全 職 非 公 務 員 合 約 僱 員 人 數 的 細 目 載 於 附 件 。 由 於 非 公 務 員 合 約 僱 員 是 在 公 務 員 編 制 以 外 受 聘 ， 公 務 員 事 務 局 並 沒 有 「 非 公 務 員 合 約 僱 員 職 系 」 的 分 類 ， 亦 因 此 未 能 提 供 按 職 系 劃 分 的 資 料 。 （ 二 ） 截 至 二 ○ ○ 九 年 六 月 三 十 日 ， 在 16,186 名 全 職 非 公 務 員 合 約 僱 員 中 ， 大 部 分 （ 12,091 名 或 約 75%） 的 持 續 服 務 年 期 （ 註 2） 少 於 5 年 ； 在 其 餘 的 員 工 中 ， 有 3,551 名 的 持 續 服 務 年 期 為 5 年 或 以 上 至 10 年 以 下 ， 544 名 則 為 10 年 或 以 上 。 公 務 員 事 務 局 沒 有 備 存 在 第 （ 二 ） 部 分 問 題 所 提 及 的 其 他 年 期 劃 分 的 統 計 數 字 ， 亦 沒 有 其 他 合 約 形 式 聘 用 的 員 工 持 續 服 務 年 期 的 資 料 。 （ 三 ） 在 過 去 5 個 財 政 年 度 ， 已 向 勞 工 處 處 長 呈 報 全 職 非 公 務 員 合 約 僱 員 工 傷 個 案 的 數 字 如 下 ︰
而 在 過 去 5 個 財 政 年 度 ， 並 沒 有 非 公 務 員 合 約 僱 員 在 執 行 職 務 期 間 因 工 作 以 致 死 亡 。 （ 四 ） 鑒 於 公 務 員 及 非 公 務 員 合 約 僱 員 的 聘 任 性 質 完 全 不 同 ， 兩 者 的 聘 用 條 款 及 服 務 條 件 並 不 宜 相 提 並 論 。 就 因 工 受 傷 或 以 致 死 亡 的 安 排 而 言 ， 由 於 《 僱 員 補 償 條 例 》 的 適 用 範 圍 涵 蓋 政 府 僱 員 （ 包 括 非 公 務 員 合 約 僱 員 ） ， 因 此 非 公 務 員 合 約 僱 員 已 受 到 有 關 條 例 規 定 的 保 障 。 政 府 僱 員 (不 論 是 公 務 員 或 非 公 務 員 合 約 僱 員 )如 在 執 行 職 務 期 間 因 工 受 傷 ， 一 般 可 享 最 多 24 個 月 的 有 薪 病 假 。 該 人 員 亦 可 享 由 政 府 或 醫 院 管 理 局 提 供 的 免 費 醫 療 服 務 。 若 該 人 員 選 擇 註 冊 中 醫 的 治 療 ， 亦 可 向 政 府 申 請 發 還 有 關 費 用 ， 發 還 的 上 限 以 《 僱 員 補 償 條 例 》 所 訂 為 準 。 至 於 因 工 受 傷 以 致 死 亡 的 補 償 ， 非 公 務 員 合 約 僱 員 的 遺 屬 可 獲 發 《 僱 員 補 償 條 例 》 規 定 的 法 定 補 償 ， 以 及 該 人 員 在 強 制 性 公 積 金 計 劃 下 的 累 算 權 益 。 至 於 在 二 ○ ○ ○ 年 六 月 一 日 或 之 後 按 新 聘 用 條 款 受 聘 的 公 務 員 ， 如 在 執 行 職 務 期 間 不 幸 因 工 殉 職 ， 其 遺 屬 除 可 獲 發 《 僱 員 補 償 條 例 》 規 定 的 法 定 補 償 ， 和 該 人 員 在 強 制 性 公 積 金 ／ 公 務 員 公 積 金 計 劃 下 的 累 算 權 益 ， 其 遺 屬 並 可 獲 政 府 發 放 一 筆 相 等 於 該 人 員 36 個 月 最 後 薪 金 的 死 亡 恩 恤 金 。 註 1： 「 全 職 」 是 指 有 關 聘 用 符 合 《 僱 傭 條 例 》 （ 第 57 章 ） 所 載 「 連 續 性 合 約 」 的 定 義 。 根 據 《 僱 傭 條 例 》 ， 僱 員 為 同 一 僱 主 連 續 服 務 4 周 或 以 上 ， 每 周 工 作 不 少 於 18 小 時 ， 即 視 為 按 「 連 續 性 合 約 」 工 作 。 註 2： 「 持 續 服 務 」 的 意 思 ， 包 括 擔 任 同 一 非 公 務 員 合 約 僱 員 崗 位 ， 或 在 同 一 部 門 無 間 斷 地 擔 任 不 同 的 非 公 務 員 合 約 僱 員 崗 位 。 二 ○ 一 ○ 年 一 月 六 日 （ 星 期 三 ） LCQ12: Protection for Non-Civil Service Contract staff injured or died while on dutyFollowing is a question by Dr Hon Pan Pey-Chyou and a written reply by the Secretary for the Civil Service, Miss Denise Yue, in the Legislative Council today (January 6): Question: A staff member who had been employed on non-civil service contract (NCSC) and worked for Radio Television Hong Kong for 21 years earlier died at work due to cerebral hemorrhages but the Government adamantly refused to grant death gratuity to his dependents on grounds that the employee was not a civil servant, and eventually only long service payment and mandatory provident fund (MPF) were granted. I have learnt that the incident has aroused public concern about the support for NCSC staff and their families. In this connection, will the Government inform this Council:
Reply: President, The Non-Civil Service Contract (NCSC) Staff Scheme, introduced in 1999, aims at providing Permanent Secretaries and Heads of Departments (hereafter shortened as 'HoDs') with a flexible means of employment to respond more promptly to changing operational and service needs of Bureaux/Departments (B/Ds) which may be time-limited, seasonal, or subject to market fluctuations; or which require staff to work less than conditioned hours; or which require tapping the latest expertise in a given area in the market; or where the mode of delivery of the service is under review or likely to be changed. NCSC staff are employed on a fixed term contract basis with an all-inclusive pay package which does not offer any fringe benefits. HoDs may determine the employment package of their NCSC staff having regard to the job nature, condition of the employment market, as well as their management and operational considerations. The terms and conditions of service for NCSC staff are overall speaking no less favourable than those provided for under the Employment Ordinance (EO) (Cap. 57) and no more favourable than those applicable to civil servants in comparable civil service ranks or with comparable levels of responsibilities where they exist. Moreover, Government employees, including NCSC staff, are covered by the Employees' Compensation Ordinance (ECO) (Cap. 282). They are thus already protected by the relevant laws, including provisions in relation to paid sick leave for injury on duty and compensation for death caused by accident arising out of and in the course of the employment. Given the nature of the NCSC Scheme, the Civil Service Bureau (CSB) only collects general information (such as the number of NCSC staff employed, the monthly salary range and the duration of contracts) twice a year from B/Ds. With the above brief explanation on the NCSC Staff Scheme, my reply to the specific questions is set out below:
Note 1: "Full-time" means the employment is on a "continuous contract" under the definition of the EO. According to the EO, an employee who works continuously for the same employer for four weeks or more, with at least 18 hours in each week, is regarded as working under a continuous contract. Note 2: "Continuous service" includes service in the same NCSC position, as well as service in different NCSC positions in the same department but without a break in service.
