入職條件: (a) 申請人必須 –

(i) 在香港或任何其他普通法適用地區獲律師或大律師資格,以及必須在2015年8月31日或之前具備自取得律師或大律師資格以後最少兩年在刑事法方面的執業經驗;或

(ii) 具備曾在香港司法機構任職司法助理的經驗;

(b) 申請人必須是香港特別行政區永久性居民;

(c) 申請人須對刑事法及程序有透徹的認識,並有能力在刑事上訴登記處及上訴法庭的實務及程序方面獲取專門知識,亦要對《刑事訴訟程序條例》、《刑事上訴規則》及《刑事訴訟實務指示》有所認識;

(d) 申請人應能有效地識別複雜事宜中的重點,並能運用良好的法律判斷力,扼要及準確地以口頭及書面方式陳述有關分析;

(e) 申請人應能在壓力下工作,包括源自工作量及工作時間的壓力;

(f) 必須擁有極佳的書寫技巧;及

(g) 具備講、閱讀和書寫中文的能力更佳。
註: 工作時數:

(a) 獲聘者須全職工作,每周44小時,且間中或須不定時工作;

(b) 然而,若獲聘者只可以兼職形式工作,本機構或可作出彈性安排,但獲聘者仍須每周工作不少於24小時,且或須不定時工作。
職責: 高院司法助理(刑事)會在高等法院上訴法庭的刑事上訴登記處內提供協助。在刑事事宜方面,上訴法庭的司法管轄權主要是就上訴許可申請及針對源自區域法院和原訟法庭的定罪及/或判刑而提出的上訴作出裁定。上訴法庭的刑事上訴登記處有機制接收、處理和管理上訴許可申請。此職位的主要職責包括 --

(a) 在案件管理的各個方面,以及在草擬撮要以供法庭用來準備和審理申請及聆訊方面協助上訴法庭的成員;

(b) 協助確保所有申請均為有效,尤其是確保申請符合實務指示,且論點已妥為識別;

(c) 在由單一法官考慮的上訴許可申請中,或在由合議庭考慮的上訴聆訊或重新申請中,就針對定罪及/或判刑而提出的上訴許可申請中的案情及所產生的法律論點擬寫案件撮要;

(d) 進行法律研究,以向上訴法庭法官以及高等法院司法常務官和副司法常務官提供意見;及

(e) 就法官所指派的題目及事宜進行研究和給予意見。
聘用條款: 獲取錄的申請人將會按非公務員合約條款聘任,為期一至兩年,並由司法機構決定會否續約。然而,若申請人以合理原因而要求比正常聘用期較遲上任或較早離任,其聘用期或可作彈性處理。
福利: (a) 獲聘者將受《強制性公積金計劃條例》的條文規限,並須向強制性公積金計劃作出僱員供款。

(b) 以全職形式獲聘者,如圓滿完成整個合約期,將可獲發約滿酬金。該筆約滿酬金,連同政府根據《強制性公積金計劃條例》的規定為獲聘者的強制性公積金計劃所作的供款,合共相等於獲聘者在合約期內所支底薪總額的10%。

(c) 以兼職形式獲聘者,將不會獲發約滿酬金。

(d) 其他福利(如適用)亦會按照《僱傭條例》的規定給予。
附註: 1. 在獲聘後,高院司法助理不得在受僱於該職位期間以任何其他形式從事私人執業及在政府和任何其他公營機構提供法律服務,包括不為任何法院或審裁處案件出庭、不作為公司或機構聘用的律師及不向當事人提供法律意見。

2. 作為提供平等就業機會的僱主,司法機構致力消除在就業方面的歧視。所有符合基本入職條件的人士,不論其殘疾、性別、婚姻狀況、懷孕、年齡、家庭崗位、性傾向和種族,均可申請本職位。

3. 非公務員合約職位並不是公務員編制內的職位。應徵者如獲聘用,將不會按公務員聘用條款和服務條件聘用。他們既不符合獲調派、晉升或轉職至政府或司法機構任何職位的資格,亦不符合享用公務員醫療及牙科福利的資格。

4. 入職薪酬、聘用條款及服務條件概以獲聘時之規定為準。

5. 司法機構的政策是盡可能安排殘疾人士擔任適合的職位。殘疾人士申請職位,如其符合入職條件,毋須再經篩選,便會獲邀參加面試。

Job Title: Judicial Associate (Criminal Appeals)
Salary: $59,445 to $77,650 per month (full-time) / $350 to $457 per hour (part-time), depending on the length of relevant post-qualification experience of individual candidates (also see “Working hours” below)
Entry Requirements: (a) Applicants must –

(i) be solicitors or barristers admitted/called in Hong Kong or any other common law jurisdiction and have at least two years’ post-qualification experience of criminal law as a solicitor or barrister by 31 August 2015; or

(ii) have previous experience as a Judicial Assistant in the Hong Kong Judiciary;

(b) Applicants must be permanent residents of the Hong Kong Special Administrative Region;

(c) Applicants should have a thorough knowledge of criminal law and procedure and the ability to acquire expertise in the practice and procedure of the Criminal Appeals Registry and the Court of Appeal, together with a knowledge of the Criminal Procedure Ordinance, the Criminal Appeals Rules and the Criminal Practice Directions;

(d) Applicants are expected to have the ability to identify the material issues in complex matters effectively and to articulate that analysis succinctly and accurately, orally and in writing, applying sound legal judgment;

(e) Applicants are expected to have the ability to work under pressure, both as to volume of work and time;

(f) Excellent writing skills are essential; and

(g) Proficiency in Chinese will be a clear asset.
Note: Working hours:

(a) Candidate is required to work on a full-time basis for 44 hours per week and occasionally involving irregular hours.

(b) However, some flexibility may be permitted in respect of candidate who may only be able to work on a part-time basis. For such candidate, he/she is required to work for not less than 24 hours per week and may be required to work irregular hours.
Duties: Judicial Associates (Criminal Appeals) are to provide assistance in the Criminal Appeals Registry of the Court of Appeal of the High Court. In criminal matters the jurisdiction of the Court of Appeal is primarily to determine applications for leave to appeal, and appeals, against conviction and/or sentence from the District Court and the Court of First Instance. The Criminal Appeals Registry of the Court of Appeal provides the mechanisms by which applications for leave to appeal are received, processed and managed. Main duties of the post-holder include -

(a) Assisting members of the Court of Appeal in all aspects of case management and the drafting of summaries for the use of the court in preparation for and conduct of applications and hearings;

(b) Assisting to ensure that all applications are effective, in particular that the applications comply with the Practice Directions and the issues are properly identified;

(c) Preparing case summaries of the facts and legal issues arising in applications for leave to appeal against conviction and/or sentence in cases considered by either a single judge, in an application for leave to appeal, or by the full court at the hearing of appeals or renewed applications;

(d) Conducting legal research in providing advice to the judges of the Court of Appeal, and to the Registrar and Deputy Registrars of the High Court; and

(e) Conducting research and giving advice on subjects and matters as assigned by the judges.
Terms of Appointment: Successful candidates will be appointed on non-civil service contract terms for one to two years and the term may be renewable at the Judiciary’s discretion. However, some flexibility may be permitted in respect of some candidates who may have reasonable grounds for starting later or finishing earlier than the normal period of engagement.
Fringe Benefits (a) The appointee will be subject to the provisions of the Mandatory Provident Fund (“MPF”) Schemes Ordinance and will be required to make employee’s contribution to a MPF Scheme.

(b) For candidate appointed on a full-time basis, a gratuity may be granted upon satisfactory completion of the full contract period. Such gratuity plus any contribution made by the Government to a MPF Scheme in respect of an appointee as required by the MPF Schemes Ordinance, will be equal to 10% of the total basic salary drawn during the contract period.

(c) Gratuity will not be granted for candidate appointed on a part-time basis.

(d) Other fringe benefits, where appropriate, will be granted in line with the provisions of the Employment Ordinance.
General Notes: 1. On appointment, Judicial Associates should not take up any other form of legal practice in the private sector and legal service in the Government and any other public organization during the period of employment as Judicial Associate, including not appearing in any case in court or tribunal, engaging as in-house counsel and offering legal advice to clients.
